Terms of Service

1. Who we are & agreeing to these terms

IslandLeads is a product and service operated by Ezy Web Pro ("IslandLeads", "we", "us"). It provides automated business-to-business (B2B) outreach services and software. These Terms of Service ("Terms") govern your use of our website and services. By buying, accessing, or using any IslandLeads service, you agree to these Terms. If you're agreeing on behalf of a company, you confirm you're authorised to bind that company.

2. What IslandLeads does

IslandLeads helps you reach other businesses. Depending on your plan, we:

• Build a prospect list of businesses from publicly available business information;
• Set up a sending system on your own email domain and tools;
• Send outreach emails and follow-ups on your behalf, and collect the replies in one place; and/or
• Set the system up and hand it over for you to run yourself.

IslandLeads is a tool and a service to help you make contact. It is not a guarantee of sales, clients, or any particular result.

3. Eligibility

You must be a business (or acting for one), at least 18 years old, and legally able to enter a contract. IslandLeads is for legitimate business use only.

4. Plans, fees & billing

• Done For You is a monthly service plus a one-time setup fee. It renews monthly and you can cancel any time; cancellation stops the next renewal and is not retroactive.
• Set Up & Hand Over is a one-time fee. After handover, you run and pay for the system yourself.
• Prices are quoted in Jamaican dollars and are subject to GCT where applicable.
• Third-party costs — your email sending service and Google/search usage — are billed to your own accounts and are your responsibility.
• Fees are non-refundable except where required by law. Setup work, once started, is non-refundable.

5. Your responsibilities as the sender

This is the most important section. When outreach goes out through your system, in the eyes of the law and the recipient, you are the sender. You are responsible for your prospect list and your message content. By using IslandLeads you confirm that:

• You have a lawful basis to contact the businesses on your list, and you are targeting businesses — not private consumers — using business contact details.
• Your messages are honest: accurate "from" and subject lines, no deception, and a clear, working way to opt out of further emails.
• You will honour opt-outs and removal requests promptly, and you won't contact anyone who has asked not to be contacted.
• You will comply with all applicable laws, including anti-spam and data-protection rules such as Jamaica's Data Protection Act, 2020, the US CAN-SPAM Act, Canada's CASL, and the EU/UK GDPR & ePrivacy rules, to the extent they apply to who you're emailing.
• You will follow our Acceptable Use & Anti-Spam Policy.
• Your content is lawful and not misleading, offensive, infringing, or harmful.

6. Data roles

For outreach campaigns we run for you, you are the data controller (you decide who is contacted and why) and IslandLeads acts as your processor, handling data on your instructions and as described in our Privacy Policy. We only use your campaign data to provide the service to you. Prospect data is business contact information; see the Privacy Policy for where it comes from and how it's handled.

7. No guaranteed results

Outreach outcomes depend on your offer, your market, your pricing, and how you handle replies — things outside our control. We do not guarantee any specific number of leads, replies, meetings, sales, or revenue. Any examples or figures we share are illustrations, not promises.

8. Email deliverability

We follow accepted best practices (proper email authentication, gradual sending warm-up, sensible volumes, and easy unsubscribe) to help your mail reach inboxes. However, whether any given email lands in an inbox, a spam folder, or is blocked is ultimately decided by the recipient's email provider. We cannot and do not guarantee inbox placement.

9. Intellectual property

The IslandLeads system, software, templates, and know-how remain our property. You get the right to use them to run your own outreach while your plan is active (or, for Set Up & Hand Over, the licensed right to run your own installed copy). Your business content, branding, and your own prospect and customer data remain yours.

10. Confidentiality

Each side will keep the other's non-public business information confidential and use it only to deliver or use the service.

11. Suspension & termination

You may cancel a monthly plan at any time. We may suspend or end service immediately if you breach these Terms or the Acceptable Use Policy, if your use threatens deliverability or our or others' reputation, or if required by law. On termination, we stop sending; you remain responsible for messages already sent.

12. Disclaimers

The service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties not expressly stated here, including fitness for a particular purpose and uninterrupted or error-free operation.

13. Limitation of liability

To the fullest extent permitted by law, IslandLeads will not be liable for indirect, incidental, special, or consequential losses, or for lost profits, revenue, data, or goodwill. Our total liability for any claim arising from the service is limited to the fees you paid us for the service in the three (3) months before the claim.

14. Indemnity

You agree to indemnify and hold IslandLeads harmless from any claims, losses, or penalties arising from your prospect list, your message content, your handling of replies and opt-outs, or your breach of these Terms or applicable law.

15. Changes to these terms

We may update these Terms from time to time. We'll post the new version here with an updated date. Continuing to use the service after a change means you accept it.

16. Governing law

These Terms are governed by the laws of Jamaica, and the courts of Jamaica have jurisdiction, without affecting any mandatory consumer rights you may have where you are based.
